If your home, work place, school, or children’s day care center were built before 1978, YOU NEED TO KNOW…
April 22, 2010, a new EPA (Environmental Protection Agency) Federally mandated law becomes effective that requires any Remodeler, Contractor, Tradesperson who disturbs six square feet or more of interior lead based painted area, or twenty square feet or more of exterior lead based painted area to:
- Be Trained and Certified as an EPA Certified Remodeler
- Test and verify IF the area to be disturbed involves lead based paint or not
- Maintain accurate records, including photographic documentation
- Establish, enforce, and adhere to prescribed safety protocols for occupants, workers, and personal effects
- Thoroughly clean the work site to prescribed protocols every day
- Provide an EPA created pamphlet “Renovate Right Important Lead Hazard Information for Families, Child Care Providers and Schools” to be given to all families in who’s home work is to be done, and if a school or day care center, to the families of every child under age 6 attending that facility

Lead contamination and poisoning is serious. Failure to comply with this new legislation carries a penalty of $32,500 per violation.
They mean serious business. And, it applies to any work not finished as of that date; meaning if you have work in progress and it fits the criteria, your project must meet and satisfy all the requirements of this new law.
The above is a very brief summary of the requirements of this law. The 13-page pamphlet is very detailed. The important issue is that the Contractor must be certified and provide you proof of that certification, and you are ultimately responsible for the safety of your family.
